The Government of India , Ministry of Law and Justice (Legislative Department) enacted an Act “The Right to Information Act, 2005 (Act No.22 of 2005)” to provide for setting out the practical regime of right to information for citizens to secure access to information under the control of public authorities, in order to promote transparency and accountability in the working of every public authority.
2. The Government hereby nominate the following Officers as State Assistant Public Information Officers under section 5 (2) of the above Act :-

i) THE POWERS, FUNCTIONS AND DUTIES OF OFFICERS AND EMPLOYEES
( Section 4(1)(b)(i)&(ii))
1. Principal Secretary to Government/Secretary to Government
He is the official head of the Department. He is responsible for careful observance of the Business Rules and Secretariat Instructions in the Transaction of Business in the Department. He exercise general supervision and control over the staff under him and he is responsible for seeing that the members of the staff do the work allotted to them efficiently and expeditiously. It is his duty to take efficient steps for the prompt dispatch of Business in the Department. One or more Additional Secretary/Joint Secretary/Deputy Secretary and Assistant Secretaries of Government usually assist the Principal Secretary/ Secretary to Government.
2. Additional Secretary to Government /Joint Secretary to Government/ Deputy Secretary to Government:
The Additional Secretary to Government /Joint Secretary to Government/Deputy Secretary to Government occupies a positions almost identical with that of Principal Secretary/Secretary to Government in regard to subject allotted to him and can send cases for orders direct to the Minister or to the Governor. He exercises also the functions of an Additional Secretary to Government. The Principal Secretary/Secretary to Government remains responsible for the subjects allotted to the Additional Secretary to Government /Joint Secretary to Government/Deputy Secretary to Government in the Department.
3. Assistant Secretary to Government:
The Assistant Secretary to Government exercise control over the Sections placed in his charge with regard to dispatch of business and in regard to maintaining discipline in the Sections.
4. Section Officer:
The Section officer is Incharge of a Section in the Department. Two Assistant Section Officers assist him. He is responsible all files relating to the subjects allotted to the Assistant Section Officers under him. He is directly responsible to the officers under whom he works for the efficient and expeditious dispatch of business in all stages in his Section. The Training of the Assistant Section Officers under him is one of his principal functions. He himself under take to deal with the more difficult or important papers. He is not expected to express his views or to suggest what orders should be passed on a case when there is clear precedent or the case is of a routine nature. He should maintain a discipline in his Sections.
5. Assistant Section Officer:
The main duties of Assistant Section Officer in a Section are to reference the communications properly and to assist the Section Officer in dealing with cases relating to his Section. He is expected to do work of a routine and mechanical nature such as maintaining the prescribed Registers, typing drafts, fair copying, dispatching and indexing.
6. Stenographers:
The Stenographers working as Private Secretaries to Principal Secretary/ Secretary to Government do shorthand work for them. The Stenographers working for Additional Secretary/Joint Secretary/Deputy Secretary to do shorthand work to them and such other items of work as are entrusted to them.
(iii). THE PROCEDURE FOLLOWED IN THE DECISION MAKING PROCESS, INCLUDING CHANNELS OF SUPERVISION AND ACCOUNTABILITY: (Section 4(1)(b) (iii))
The procedure involved in decision making is by way of consulting the specialized Department in that field like, Finance, General Administration and Law Departments, circulate the file to the concerned Minister and Chief Minister, through Chief Secretary wherever necessary. The business has to disposed of by the Prl.Secretary on all matters based on the delegation of powers for such disposal.
(iv) THE NORMS SET BY IT FOR THE DISCHARGE OF ITS FUNCTIONS:
(Section 4(1)(b)(iv))
The business of the Government shall be transacted in the Department as per the Business Rules and in terms of the SOM, obtain the required budget allocation by placing necessary proposals to the Legislature through Finance Department for the various schemes that are sanctioned and that are to be taken up based on the priority for the benefit of the State and streamline the expenditure.
Submit Memoranda to the Council of Ministers for clearance of various proposals and schemes and to implement the directives of the Government, Interact with Government of India for clearances and approvals for various schemes of the Government.
(v) The rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions;
The Transport Department consists of the Transport Department Service Rules for gazetted category issued in G.O.Ms.No.180, TR&B (Tr.I) Department, dated 1.7.1994. The service consists of the posts from Additional Transport Commissioner, Joint Transport Commissioner, Deputy Transport Commissioner, Regional Transport Officer and Motor Vehicle Inspectors. The various methods of recruitment to those categories, qualifications for promotions etc. have been specified in those rules. The RTOs recruitment by transfer from Superintendents. Section Officers of Secretariat and P.S. to Secretaries have to be pass the account tests for executive officers or the Account Tests for Subordinate Officers Part-I & II and Transport Department Test part-I & II.
2. The Transport Subordinate Service Rules issued in G.O.Ms.No.529, TR&B (Tr.I) department, dated 4.6.1999 consists of several categories of posts from Transport Constable to Asst.Motor Vehicle Inspectors. The Direct Recruitment AMVIs have to pass the following tests during the period of probation.
1) Motor Vehicles Act, 1988
2) A.P.Motor Vehicle Taxation Act, 1963 and the rules made thereunder.
3) A.P.Revenue Recovery Act, 1864
4) Code of Criminal Procedure, 1973 (Central Act, 2 of 1974) and the Criminal rules of Practice and the District Office Manual.
5) Account Test for Executive Officers/Account Test for Subordinate Officers part-I and II.
6) Motor Vehicles Rules/Driving Licence Rules
3. The Transport Department manual is not yet prepared.
(vi): A statement of the categories of documents that are held by it or under its control:
The following rules, regulations/manuals have been prescribed to the Transport Department;
i) A.P.Transport Service Rules, (G.O.Ms.No.180, TR&B (Tr.I) Department, dated 1.7.1994 and G.O.Ms.No.529, TR&B (Tr.I) Deptt., dated 4.6.1999.
ii) Transport Department Test Rules, Part-I and II.
iii) Motor Vehicles Act, 1988
iv) A.P.Motor Vehicle Taxation Act, 1963 and the rules made thereunder.
(vii) Arrangements for consultation:
The Government have formed State Transport Authority. Vide G.O.Ms.No.95, T.R&B (Tr.I) Deptt. dated. 11-5-2005. There are five members on the Committee and two among them are non officials. Similarly there are District Road Transport Authority at district level in all the districts with three members on the committee one of them being a non-official. Vide G.O.Ms.No.96, T.R&B (Tr.I) Deptt. dated.11-5-2005.
At the district level there exist Road Transport Authorityies. There are 23 RTA s in the state. The functions of RTA are:-
a) grant of stage carriage permits.
b) grant of variations in respect of State carriage.
c) any matter falling under section 71 (3) of the APMV Act, 1988.
d) Deligation of powers.
e) Making any bye-law for transacting the business of RTA.
At the state level there is a State Level Road Safety Council. Every district has a Road Safety Council. The details on members are given in item(viii). There are district committees for curbing illicit operations in the State. The Government had constituted Road Safety Council at State Level vide G.O.Ms.No.159, T.R&B (Tr.I) Department, dt.5-8-2005 with Minister (Transport) as Chairman and 17 others as Members and the Transport Commissioner is Member-Convener. The District Level Committees also constituted vide G.O.Ms.NO.160, T.R&B (Tr.I) Department, dated.5-8-2005. The Superintendent of Police as Chairman, the Joint Collector as Vice-Chairman and DTCs/RTAs as member convener for the each District Level Committee. It is stated that in respect of Hyderabad and Secunderabad the Committee is headed by the Deputy Commissioner of Police, Traffic as Chairman and the Joint Commissioner and Secretary, RTA, Hyderabad will be Member-Convener.
(viii) A statement of Boards, Councils, Committees and other Bodies.
Information in respect of Section 4(1), B of the said Act, so far relates to TR.II Section is as follows:
The APSRTC is under the administrative control of Transport-II section. The matter relating to Administration and Financial of APSRTC constitution of APSRTC i.e. appointment of nominees of Central and State Govt. and non-officials on the Board. Review of monthly Performance Reports of RTC. APSRTC Recruitment Regulations, Meeting of APSRTC and other related matters.
The APSRTC established under the Road Transport Corporation Act, 1950 (Central Act No.64 of 1950).
MANAGEMENT OF CORPORATION AND BOARD OF DIRECTORS:-
(1) The Superintendence, direction and management of the
affairs and business of a Corporation shall vest in a Board
of Directors which, with the assistance of its Committees
and Managing Director, may exercise all such powers and
do all such acts and things as may be exercised or done by
the Corporation.
(2) The board shall consist of a Chairman and such other Dire-
ctors, being not less than five and not more than seventeen,
as the State Government may think fit to appoint.
(3) The State Government may, if it is so thinks fit, appoint one
of the other Directors as the Vice-Chairman of the Board.
(4) Rules made under this Act shall provide for the representation,
both of the Central Government and of the State
Government concerned, on the Board in such proportion as
may be agreed to by both the Governments and of appoint-
ment by each Government of its own representatives thereto
and where the capital of a Corporation is raised by the issue
of shares to other parties under sub-section (3) of Sec.23,
provision shall also be made for the representation of such
share holders on the Board and the manner in which the
representatives shall be elected by such share holders.
MEETINGS OF BOARD:-
(1) A Board shall meet at such times and places and shall,
subject to the provisions of sub-sections (2) and (3)
observe such rules of procedure in regard to transaction
of business at its meetings as may be provided by
regulations made under this Act:
Provided that the Board shall meet at least once in
every three months.
(2) The person to preside at a meeting of a Board shall be
the Chairman thereof, or in his absence from any
meeting, the Vice-Chairman, if any, or in the absence
of both the Chairman and the Vice-Chairman, such
Director as may be chosen by the Directors present
from among themselves to preside.
(3) All questions at a meeting of a Board shall be decided
by a majority of votes of the Directors present, and in
the case of equality of votes, the Chairman or, in his
absence, any other person presiding shall have a
second or casting vote.
OFFICERS AND EMPLOYEES OF THE CORPORATION:-
(1) Every Corporation shall have a Managing Director,
a Chief Accounts Officer and a Financial Adviser,
appointed by the State Government;
Provided that the same person may be appointed as
the Chief Accounts Officer and the Financial Adviser;
(2) A Corporation may appoint a Secretary and such
other officers and employees as it considers necessary
for the efficient performance of its functions:
MANAGING DIRECTOR, CHIEF ACCOUNTS OFFICER AND
FINANCIAL ADVISER:-
(1) The Managing Director shall be the executive head of
the Corporation and all other officers and employees
of the Corporation shall be subordinate to him.
(2) The Managing Director shall obtain the views of the
Chief Accounts Officer and the Financial Adviser, or,
as the case may be, the Chief Accounts Officer-cum-
Financial Adviser, on every proposal involving revenues
or expenditure from the fund, of the Corporation and
shall cause such views to be placed before the Board
prior to the consideration of such proposal by the Board.
POWERS AND DUTIES OF CORPORATION
GENERAL DUTY OF CORPORATION:-
It shall be the general duty of a Corporation so to exercise its power as progressively to provide or secure or promote the provision of, an efficient, adequate, economical and properly co-coordinated system of road transport services in the State or part of the State for which it is established and in any extended area.
Provided that nothing in the section shall be construed as imposing on a Corporation, either directly or indirectly, any form of duty or liability enforceable by proceedings before any court or tribunal to which it would not otherwise be subject.
POWERS OF CORPORATION:-
(1) Subject to the provisions of this Act, a Corporation shall have power --
(a) to operate road transport services in the State and in any
extended area;
(b) to provide for any ancillary service;
(c) to provide for its employees suitable conditions of service
conditions of service including fair wages, establishment
of provident fund, living accommodation, places for rest
and recreation and other amenities:
(d) to authorise the issue of passes to its employees and other
persons either free of cost or at concessional rates and on
such conditions as it may deem fit to impose;
(e) to authorise the grant of refund in respect of unused tickets
and concessional passes.
(2) Subject to provisions of this Act, the powers conferred by sub-
section (1) shall include power --
(a) to manufacture, purchase, maintain and repair rolling
stock, vehicles, appliances, plant, equipment or any
other thing required for the purpose of any of the
activities of the Corporation referred to in the sub-
section (1).
Explanation:- In the clause, the expression, “manufacture” does
not include the construction of the complete unit
of motor vehicle except for purposes of experiment
or research;
(b) to acquire and hold such property, both movable and
immovable as the Corporation may deem necessary
for the purpose of any of the said activities, and to
to lease, sell or otherwise transfer any property held
by it;
(c) to prepare schemes for the acquisition of, and to
acquire, either by agreement or compulsorily in
accordance with the law of acquisition for the time
being in force in the State concerned and with such
procedure as may be prescribed whether absolutely
or for any period, the whole or any part of any undertaking
of any other person to the extent to which the activities
thereof consist of the operation of road transport services
in that State or in any extended area;
(d) to purchase by agreement or to take on lease or under
any form of tenancy any land and to erect thereon such
buildings as may be necessary for the purpose of carrying
on its undertaking.
(e) to authorise the disposal of scrap vehicles, old tyres,
used oils, any other stores of scrap value or such other
stores as may be declared to be obsolete in the
prescribed manner;
(f) to enter into and perform all such contracts as may be
necessary for the performance of its duties and the
exercise of its powers under the Act;
(g) to purchase vehicles of such type as may be suitable
for use in the road transport services operated by the
Corporation;
(h) to purchase or otherwise secure by agreement vehicles,
garages, sheds, office buildings, depots, land, workshops,
equipment, tools, accessories to and spare parts for
vehicles, or any other article owned or possessed by the
owner of any other undertaking for use thereof by the
Corporation for the purpose of its undertaking;
(i) to do anything for the purpose of advancing the skill of
persons employed by the Corporation or the efficiency
of the equipment of the Corporation or of the manner in
which that equipment is operated, including the provision
by the Corporation, and the assistance by the Corporation
to others for the provision of facilities for training, education
and research;
(j) to enter into and carry out agreements with any person
carrying on business as a carrier of passengers or goods
providing for the carriage of passengers or goods on
behalf of the Corporation by that other person at a thorough
fare or freight;
(k) to provide facilities for the consignment, storage and
delivery of goods;
(l) to enter into contracts for exhibition of posters and adver-
tising boards on and in the vehicles and premises of the
Corporation and also for advertisement on tickets and
other forms issued by the Corporation to the public;
(m) with the prior approval of the State Government to do all
other things to facilitate the proper carrying on of the
business of the Corporation.

The Budget allocated to each of its agency indicating the particular of all plans proposed, expenditures and reports on disbursements made.
The Head of the Department for Transport Dept., is the Commissioner of Transport who sends the proposals on Budget including Details of Plans and Non-Plans. Accordingly Transport Department allocates its yearly Budget to the Transport Commissioner with the concurrence of Finance Department. .
The Budget for 2005-06 under Demand No.VIII is as follows:-

The Non-plan expenditure is intended to meet the cost of the Administration to ensure an effective transport system in the State and to enforce the provision of the Act and Rules.
The main function of the Transport Department is, it is essentially an Enforcement and regulatory agency. Its objectives are :
1) To promote economical passenger transport facilities by regulating fares and number of public service vehicles.
2) To promote efficient transport by regulating type/number and routes in which passenger vehicles ply.
3) To promote accident free passenger transport by regular inspection of passenger transport vehicles for fitness.
4) To provide connectivity to remote and interior villages by giving permits to R.T.C. and private agencies.
5) To regulate and improve driver competence by conducting driving tests on scientific lines and supervision of Driving Schools.
6) To provide incentives to efficient goods transport by suitable taxation policy.
7) To regulate goods transport movement for cheaper alternatives.
It is also submit that under Plan schemes an amount of Rs.1000.00 lakhs has been allocated for improvements and safety works of Highways.
The policy initiatives of the Department are:-
Computerisation of Check posts with automatic weighment. Simplification of procedures in vehicle registration / licensing and tax payment. Any transaction at any transport office in the State. “e” seva linkup for all tax payments. Regular training for field staff in preventing accidents. Stress on HRD by building up cadres at every level.
It is an achievement for the Transport Department as the revenue collections during the year 2004-05 under M.V.Tax have shown 20.96% growth over the previous year due to increase in the rate of taxes in certain category of vehicles as well as buoyancy in registration of certain categories.
The computerization is implemented in 38 RTO offices 76 unit and MVI`s and 33 AMVI offices across the State rendering services to the citizen. The service charges collected during 2005-06 is 30.57 crores and the number of transactions made are 46.39.
As the existing infrastructure is not sufficient to tackle the problem, private entrepreneurs has been encouraged to establish pollution testing stations. The Department is also having a Citizens` Charter to provide the information and above all, to arrest the misuse of documents like permits, registration certificates, driving licenses, no-objection certificates etc. , the Transport department has started using holograms as a security measures by affixing them on the documents issued by the subordinate offices. Pre-printed stationery is being supplied as a security measure.
(xii) The manner of execution of subsidy programmes including the amounts allocated and the details of beneficiaries of such programmes. Nil.

Tax exemptions allowed to charitable organizations under GO Rt No.2279, Home (Tr.II) Department, dated. 20-8-1974. The prescribed proforma in which information is to be furnished to the Transport Commissioner:

Authorizations : Interstate services are granted by the department.
