In exercise of the powersconferred by sub-section (1) of 262 read with sub-section(1) of section 268 of the AndhraPradesh Panchayat Raj Act, 1994 (Act 13 of 1994) and in supersession of the rules issuedin G.O.Ms.No.669, Panchayat Raj, dated the 4th June, 1965, the Governor ofAndhra Pradesh hereby makes the following rules relating to the emergency powers of theGovernment, Commissioner and District Collector.
R U L E S
Short tile 1. These rulesmay be called the Andhra Pradesh Panchayat Raj (Emergency powers of the Government,Commissioner and District Collector) Rules, 2000.
Definitions 2. In theserules, unless the context otherwise requires, "Act" means the Andhra PradeshPanchayat Raj Act, 1994.
Emergency 3. In everycase in which the powers are conferred by section 262 of Powers of the Act, theGovernment, the Commissioner or the District Government, Collector are empowered toexecute or get executed any work Commissioner which is in their opinion necessary for thesafety of the public.
and Collector (1) If suchpowers are exe3rcised by the Commissioner, he shall forthwith report to the Governmentwithin fifteen (15) days along with reasons specified therein, with a copy to the DistrictCollector concerned.
(2) In case, such powersare exercised by the District Collector, he shall forthwith report to the Commissioneralong with the reasons for the exercise of such powers and a copy of the report shall, atthe same time, be sent to the Gram Panchayat for information.
(3) if the Governmentexercise such powers under sub-section (2) the reasons and circumstances, under which theaction is taken shall be set out in the order, and a copy of the same shall be forwardedto the Commissioner, Panchayat Raj and the District Collector concerned.
(4)Before taking actionunder this rule, due notice shall be given to the Panchayat Raj Body concerned, givingtime of fifteen (15) days, to submit their opinion in the shape of resolution.
