APPENDIX N O T I F I C A T I O N Whereas, the Government with a view to have a clear transparent policy and keeping in view of road widening and civic development programme taken up by the Municipal Corporation of Hyderabad, the Government proposed to declare certain roads / stretches as Commercial Roads by authorizing Commissioner, Municipal Corporation of Hyderabad to grant Building Permission for Commercial / Institutional / Residential except Industrial use at the options of the owners. Accordingly, the Government in Memo.No.21244/I1/2001-4 M.A., and Memo.No.21244/I1/2001-5 M.A., dated 02.05.2002 issued draft Notification under sub-section (2) and (3) of section 12 of Andhra Pradesh Urban Areas (Development) Act, 1975 (Act 1 of 1975) read with rule 13-A of the Urban Development Areas (Hyderabad) Rules, 1977 inviting objections and suggestions on declaration of certain roads / stretches of roads shown in the Annexure to the Notifications of the said Memos. as Commercial roads by authorizing the Commissioner, Municipal Corporation of Hyderabad to grant Building Permission in plots abutting to these roads / stretches for construction for Commercial / Institutional / Residential use buildings except Industrial use at the options of owners of the plots irrespective of the usage envisaged in the Master Plan / Zonal Development Plan, subject to conditions mentioned 2. -- 2 -- therein, so as to facilitate the owners / developers to have a clear picture about the uses permitted along the notified roads and directly approach the Municipal Corporation of Hyderabad for commercial / Institutional / Residential Building Permissions instead of individually approaching the Government for Change of Land Use. Whereas, in the said notifications it was mentioned that the above drafts will be taken into consideration after expiry of fifteen days from the date of publication of Notifications in the Andhra Pradesh Gazette and any objection or suggestion received from any person with respect to the above notifications before expiry of the said period will be considered. The said Notifications were published in the Extraordinary issue of Andhra Pradesh Gazette No.202, dated 04.05.2002. Whereas, in response to the said Notifications Government have received twelve objections / suggestions as detailed below. Whereas, the objection filed by Sri A. Bal Reddy, Advocate, Himayathnagar with regard to exemption of Impact Fee to the affected land owners has been examined in detail and Government observes that as per G.O.Ms.No.483 M.A., dated 24.08.1998 the land owners whose properties are affected under road widening are eligible to get certain incentives in terms of additional FAR, relaxation of Setback / Coverage. Further, permitting Commercial use along the notified roads will confer certain increments in land values to land owners / developers and a portion of it has to be paid by them to Municipal Corporation of Hyderabad as Impact Fee. Hence, this objection is overruled. Whereas, the objections filed by Sri Gopal Reddy, Ameerpet, Thakur Hridyanath Singh, C. Anjaneyulu, Bollaram and resident of Plot No.17, Venkateswara Hills, Road No.3, Banjara Hills requesting the Government to drop the proposal representing that the G.O. will benefit only to the owners and builders whose properties are abutting to these roads which constitutes only negligible percentage and change of commercial use will create congestion, parking problem, traffic problem, Noise and Air pollution and the proposal will not solve the problems for which additional funds thus generated are proposed to be utilized have been examined in detail and Government observes that the concept in declaring certain roads as Commercial is to spread the commercial activities all over the city and to discourage the commercial activities in the interior areas so that there will be no traffic pressure on particular areas. Moreover public in various areas should have easy access to commercial areas. Further part of these roads have already become predominantly / partly commercial and others are emerging to in response to the demand from public and business. Further, the Government took the existing realities into consideration before issuing the draft notifications to have the clear transparent policy. Further, permitting Commercial use along the notified roads will confer certain increments in land values to land owners / developers and Government has permitted the Municipal Corporation of Hyderabad to tap a portion of this by levying Impact Fee to utilize the amounts so derived to take up the de-congestion programmes in the twin cities. Hence, these objections are overruled. Whereas, the objections raised by Sri Reddy, Banaja Hills, Sri J.V.Kumar, Kakatiyanagar and Sri Hanumantha Reddy, Plot No.17, Banjara Hills with regard to levy of Impact Fee has been examined in detail and Government observes that permitting Commercial use along the notified roads will confer certain increments in land values to land owners / developers and hence, permitting the Municipal Corporation of Hyderabad to tap a portion of this by levying Impact Fee is basically to utilize the amounts so derived to take up the de-congestion programmes in the twin cities. Hence, these objections are overruled. Whereas, the suggestion given by Smt. Snehalatha, Musheerabad with regard to incorporating a condition in the G.O that the Impact Fee does not applicable to the sites which are already earmarked for Commercial purpose in the Master Plan / Zonal Development Plan has been examined in detail and agreed to. Whereas, the suggestions given by Sri Y. Raghava Rao and Sri E. Chaitanya Murthy regarding inclusion of road leading from RTC X Roads junction to Hindi Mahavidyala Junction (Nallakunta Road) as Commercial road has been examined in detail in consultation with Commissioner, Municipal Corporation of Hyderabad and observed that there is a possibility for development of Commercial activity along this road and hence agreed to include the same in the notified list. Whereas, the suggestion given by Sri Syed Hussain, Yellareddyguda regarding inclusion of 60-00 road from Ameerpet X Roads to Yellareddyguda as Commercial road has been examined in detail in consultation with Commissioner, Municipal Corporation of Hyderabad and observed that the existing road is varying from 28-00 to 30-00 only and most of the are is covered by residential buildings and there is no such major commercial activity on the road and Hence, the suggestion is not agreed for. 3. -- 3 -- Whereas, the objection / suggestion filed by Mr. Mohd. Khadeer Khan, G.P.A Holder for Smt. Fazalunnisa Begum, Somajiguda with regard to exempt her from payment of Impact Fee OR to give some concession in Impact Fee OR to adjust the same towards the notional cost of the land affected under the road widening has been examined in detail and Government observes that no concession can be given to one individual as the decision to declare Commercial roads, is a general policy decision of the Government and collection of Impact Fee is applicable to all. Hence, this objection is overruled. In view of the above, in exercise of the powers conferred by sub-section (2) of section 12 of the Andhra Pradesh Urban Areas (Development) Act, 1975 (Act-I of 1975) the Government hereby declare the roads / stretches as given in Annexure appended to this notification as Commercial roads, the same having been previously published in the Extrordinary issue of Andhra Pradesh Gazette No.202, Part-I, dated 04.05.2002 as required by sub-section (3) of the said section, to have a clear transparent policy keeping in view the road widening and civic development programmes taken by the Municipal Corporation of Hyderabad, and authorize the Commissioner, Municipal Corporation of Hyderabad to grant Building Permissions for proposed constructions for Residential / Commercial / Institutional use except Industrial use at the option of the owners of the site abutting these roads irrespective of the usage envisaged in the Master Plan / Zonal Development Plan, subject to the following conditions; namelu:- Commercial / Institutional use is permissible to the extent of property irrespective of usage assigned in Zonal Development Plan / Master Plan abutting the road with single or multiple title deeds, so as to encourage bigger complexes along major roads. no row type shops (mulgies) shall be allowed on these roads. the party shall pay the Impact Fee and other usual charges to the Municipal Corporation of Hyderabad prior to taking building permission. these shall be no compound wall allowed or permitted toward road side so as to utilize the area for incidental or short duration parking. the Commissioner, Municipal Corporation of Hyderabad shall levy and collect Impact Fee at the following rates while permitting Commercial / Institutional uses for the sites / properties abutting to notified Commercial Roads in the Municipal Corporation of Hyderabad Area:- (a) (i) Rs.50/- per Square Foot for Ground Floor. Rs.50/- per Square Foot for the First Floor. Rs.25/- per Square Foot for permitted subsequent Floors. the Commissioner, Municipal Corporation of Hyderabad is authorized to permit mixed uses i.e., either Commercial or Residential at the option of the owners of the site on Upper Floors i.e., 2nd Floor and above, however, after levying Impact Fee of Rs.25/- for Square Foot for such permitted upper floors. When mixed uses are allowed, the parking requirements for the residential flats shall be insisted on the stilt floor which may be in addition to the basement. the Impact fee as stipulated above and collected shall be deposited in a separate account by Municipal Corporation of Hyderabad. The amount so collected shall be utilized for the Capital improvement and Decongestion Plan i.e., for the works such as Road Widening, Link Roads, Slip Roads, Parallel roads, Junction Improvements including Traffic Signals, Flyovers, ROBs, RUBs, Modern Lighting on Major Roads, Development of Major Nalas, Development of Parks to be executed by the Commissioner, Municipal Corporation of Hyderabad with the prior approval of Government. In no circumstances, the amount shall be credited to General Revenue and spent for salaries and maintenance works etc. the Commissioner shall furnish a copy of all such plans sanctioned along the notified roads to the Vice-Chairman, Hyderabad Urban Development Authority for necessary further action to update Master Plan / Zonal Development Plan at every three months interval. The Commissioner, Municipal Corporation of Hyderabad shall also furnish periodic reports to Government. that title, Urban Land Ceiling / Agriculture Ceiling aspects shall be scrupulously examined by Municipal Corporation of Hyderabad before the issue of the building permission / development permission. 4. -- 4 -- there shall be increase of 10% on Impact Fee (as specified at condition No.5) each year i.e., from 1st April of every year. the applicant shall pay the conversion charges for the land / plot area to Hyderabad Urban Development Authority before approaching the Municipal Corporation of Hyderabad for grant of building permission and Municipal Corporation of Hyderabad shall insist the same before granting the building permissions. the Impact Fee is not applicable to the sites which are already earmarked for Commercial / Institutional purpose in the Master Plan / Zonal Development Plans.
