                        The Commissioner and Director of Municipal Administration has reported  to Government that Sri K.Prabhakar  Rao originally appointed as Record Assistant inMunicipal High School, Gudur Municipalitity and continued as such till 1983, that  on being certified by Medical Officer, LeprosyUnit that Sri K.Prabhakar Rao, was leprosy patient, he was appointed as compost  watchman vide Council Resolution NO.201, dt.29.09.83 and he was paid salary in the cadre of Record Assistant.   It is further reported that he was due toretire on 30.06.1996 on attaining the age of 58 years, but he was allowed to continue till30.06.1998 ie., till he attained the age of 60 years treating his services as Class IVservices and paid the allowances till 30.06.1998.   The Commissioner and Director of Municipal Administration has further  reported that the pensionary benefits were notreleased to Sri K.Prabhakar Rao, Retired Record Assistant for want of settlement of hisoverstayal  period from  01.07.1996 to 30.06.1998 and requested  to treat his overstayal period as re-employment soas to pay the pensionary benefits to the retired Record Assistant.

                        The Government have carefully examined the proposal of the Commissioner andDirector of Municipal Administration and decided to treat the period   of overstayal of Sri K.Prabhakar Rao RetiredRecord Assistant from 01.07.1996 to 30.06.1998 as re-employment and to recover the excesspayment made to him for this period from the Gratuity.

                        The Government under Rule 42 of  A.P.RevisedPension Rules, hereby direct that the period of overstayal of Sri K.Prabhakar Rao, RetiredRecord Assistant of Gudur Municipality  from01.07.1996 to 30.06.1998  be treated asre-employment and the excess payment made to him for the overstayal period  be recovered from his gratuity.

                        This order issues with the concurrence of Finance and Planning (FW.Pen.II)Department vide their U.O.No.50187/464/P2/99, dt. 07.01.2000.
