REVISION
OF MINIMUM RATES OF WAGES IN THE EMPLOYMENT IN “SHOPS AND COMMERCIAL
ESTABLISHMENTS” IN PART-I SCHEDULE OF THE MINIMUM WAGES ACT, 1948 – FINAL
NOTIFICATION.

In exercise of the powers conferred
by sub-section (1) of section 3 and sub-section (2) of section 5 of the Minimum
Wages Act, 1948 (Central Act 11 of 1948) and of all other powers hereunto
enabling and after having consulted the State Minimum Wages Advisory Board, the
Governor of Andhra Pradesh hereby fixes the minimum rates of wages which shall
consist of basic wage and cost of living allowance as specified in column (3)
of the Schedule below as payable to each category of the employees specified in
the corresponding entry in column (2) thereof and employed in the employment in
“Shops and Commercial Establishments” which is specified in part-I of
the Schedule to the Minimum Wages Act, 1948 in the State of Andhra Pradesh as
the same having been previously published as required under clause (b) of
sub-section (1) of section 5 of the said Act.
The minimum rates of wages so fixed
shall come into force with effect from the date of publication of this notification
in the Andhra Pradesh Gazette.

Cost of
Living Allowance:
(A) The minimum basic rates of wages are linked to consumer price index for the industrial workers at 411 points (Base year 1982=100 series). For any rise in cost of Price Index over and above this level. The cost of living allowance shall be paid as specified below.

and for an increase of every
Rs.50/- in the basic wages and part thereof 0.25 Paise shall be paid as VDA
subject to the limitation of Rs.10.50 for basic wage of Rs.2000/- and above.
Example:
Rs.501 to 550 Rs.3.25
Rs.551 to 600 Rs.3.50
(B)
The
Cost of living allowance shall be notified by the
Commissioner of Labour, for every six months i.e., 1st April, and 1st
October. For this purpose the average rise in the state industrial workers
consumer price index numbers for half year ending December and June
respectively shall be taken into account.
NOTE:
1.
If
any categories employed in the above employment are left out, they should not
be paid less than the minimum wages fixed in the category of the worker, being
the same and similar category of work in this employment.
2.
Where
piece rate workers are employed, the remuneration paid to each of them for a
normal working day shall not be less than the minimum wages fixed for a general
worker being a similar work, calculated on the basis of 8 hours a day.
3.
To
arrive at a daily rate, the monthly rate shall be divided by 26 which included
the rest day wages.
4. Where the nature of work is the same, no discrimination on the
payment of minimum rates of wages should be made in respect of men and women
workers.
5. If any category of employees not included in this scheduled
employment, shall be paid same notified wage of the similar categories in any
other scheduled employment, if the same category is existed in more than one employment the higher wage
should be paid.
NOTE:
1.
Zone-I
Comprises of;
(a) All Municipal Corporations in Andhra Pradesh.
(b) Selection Grade and
Special Grade Municipalities.
2.
Zone-II Comprises of the rest of the areas.
For the purpose of schedule:
(a)
Tradesman:
Tradesman means the categories like Electrician, Radio Mechanic, Optical
Mechanic Surfacer, Grinder, Photographer, Photo Artist, Typewriter, Mechanic,
T.V. Mechanic, Fitter, Turner, Welder and Plumber Mason etc.
(b)
Driver
shall get the minimum wages fixed for the category of Employment in Private
Motor Transport under the Minimum Wages Act.
