The following rules will be published in theExtraordinary issue of the Andhra Pradesh Gazette:-
N O T I F I C A T I O N
In exercise of the powers conferred bysub-section (1) of section 130 of the A.P. Co-op. Societies Act, 1964 read with Clause(xv)of Bye-law 21 (1) and Bye-law 24(d) of the Bye Laws of the Co-operative Sugar Factoriesand in supersession of the orders issued in G.O.Ms.No.331, Ind & Com (Sugar.II)Deptt., dt.18-7-1985 and the orders as subsequently amended the Government hereby makesthe following "rules/regulations for appointment to the posts of Managing Directorsof Co-operative Sugar Factories in the State".
R U L E S
1. SHORT TITLE AND COMMENCEMENT
(1) These rules may be called the Andhra Pradesh Co-operativeSugar Factories (Managing Directors) Rules, 2000.
(2) These rules shall come into force at once.
In these rules unless the context otherwise requires, -
(i) Society means the Co-operative Sugar Factory;
(ii) Bye-law means the bye-laws of the Co-operative SugarFactoriries;
(iii) Government means the Government of AndhraPradesh;
(iv) Authority means the Government of AndhraPradesh;
( v) Managing Director means the Managing Director ofCo-operative Sugar Factory as specified in the Bye-laws.
(vi) Year means the Sugar Year commencing from theIst October to 30 the September.
(vii) Recruitment Committee means the Committeeconstituted by the Government for direct recruitment to the posts of Managing Directors ofthe Co-operative Sugar Factories.
3. Recruitment Committee:-
The Recruitment Committee shall consist of thefollowing namely :-
(1) Prl. Secretary/Secretary to Government Chairman/Chairperson

Industries & Commerce Department
(2) Commissioner of Sugar/ Member/
Director of Sugar Convenor
(3) Commissioner/ Member
Director of Agriculture
(4) Additional Secretary/ Member
I/c of Sugar Industry
Industries & Commerce Department
(5) The President and if there is no President , Member
Person-in-Charge of one of the Cooperative
Sugar Factories to be nominated by the
Commissioner of Sugar and Cane
(6) Technical Person to be Co-opted by the Member
Commissioner of Sugar and Cane
Commissioner/Director of Sugar and
4. METHOD OF APPOINTMENT:
The method of appointment to the posts ofManaging Directors of Co-operative Sugar Factories shall be made, -
(i) "by selection from among qualified Common Cadre Officersworking in Co-operative Sugar Factories."
(ii) by direct recruitment, if no suit;able and qualifiedcandidates are available among the Common Cadre Officers; or
(iii) by deputation of officers from I.A.S., or A.P.A.S.
(1) In direct recruitment, preference shall be given to the Common Cadre Officers already in service of Co-operative Sugar Factories of Andhra Pradesh according to seniority where the merit and ability are approximately equal ; provided they are otherwise found eligible and fit in other respects.
(2) These rules shall not adversely affect the services of the Managing Directors, who were already appointed on contract basis and whose services were regularised in G.O.Ms.No.34 and 35, Industries and Commerce (Sugar.II) Department, dt.4-2-1994.
(3) In respect of direct recruitment, the rule of reservation in respect of SCs., and STs., and BCs., shall be followed.
4) Nothing in these rules shall affect the Common Cadre Officers who are holding full additional charge of the Managing Directors in Co-operative Sugar Factories and appointed as Managing Directors on adhoc basis for the season 1993-94 for appearing before the Selection Committee for selection to regular appointment.
5. FUNCTIONS OF THE RECRUITMENT COMMITTEE:
The functions of the Recruitment Committee shall be to interview, select and draw up a pannel of suitably officers for posting as Managing Directors in Co-operative Sugar Factories.
NOTE: Calling of applications and processing shall be made bythe Director of Sugar and Cane Commissioner
6. APPOINTING AUTHORITY:
The Govt. shall be competent authority to appoint Managing Directors in Co-operative Sugar Factories in the State from out of the persons empanelled by the Recruitment Committee. The selected candidates shall be liable to save in any Sugar factory in the State and also liable for transfer.
(1) Candidates for direct recruitment to the posts of Managing Directors of Co-op. Sugar Factories shall possess the following qualifications namely
(a) A degree in Mechanical or Electrical or Chemical Engineering or Sugar Technology;
(b) B.Sc (Chemistry) with associate Membership of ANSI/VDSI or B.Tech. (Chemical Engineering or Technology with associate Membership of ANSI/VDSI;
(c) Associate Membership of the Institute of Chartered Accountants or Cost and Works Accountants or Cost Accountants;
(d) M.B.A., or Associate Membership of Institute of Company Secretaries or Post Graduate in Personnel Management or Public Administration or Political Science with Public Administration;
(e) B.Sc., (Agriculture)
The candidate shall have Minimum of 10 years experience in No.2 position in Sugar Industry, subject to fulfilment of other conditions and suitability. Preference shall be given to the candidates possessing ANSI, VDSI., and higher qualifications.
8. TENURE OF APPOINTMENT:
The Managing Directors of the Co-operative Sugar Factories shall be appointed on regular basis.
The candidates for direct recruitment to the post of Managing Directors shall not have completed the age of 53 years. The candidates belonging to SC/ST the maximum age limit will be relaxed by 4 years.
10. AGE OF SUPERANNUATION:
No Managing Director shall be continued inservice beyond the age of 58 years.
11. SCALE OF PAY:
The Managing Director directly recruited shall draw pay in the scale of Rs.7070-230 -7300-280-10,100/-. The pay shall carry D.A., on par with the Govt.officers. The Revision of pay scale of Managing Directors shall come into force with effect from 1-1-1995.
|House Rent Allowance|| |
20% on basic pay subject to a maximum of Rs.1,000/0 who are working at Head Office. If quarter is provided he is not entitled for HRA.
|Medical Allowance|| |
Rs.75/- p.m. where Hospital facility is not there.
|Conveyance Allowance|| |
Rs.480/- p.m. shall be paid to the Managing Directors who are having their own car and working at Head Office. If factory car is provided conveyance allowance is not eligible.
As per payment of the Gratuity Act.
13. LEAVE ELIGIBILITY:
irector of Sugar shall be the competent authority to sanction the leave to the Managing Directors of the Co-operative Sugar Factories. They shall be eligible for the following leaves in a year:-
Casual Leave : 15 days
Optional Holidays: 5 days
Earned Leave: 30 days
14. ACCUMULATION OF EARNED LEAVE:
The Managing Directors of Co-operative Sugar Factories are permitted to accumulate 240 days of E.L., and to encash the same at the time of retirement or death.
15. LEAVE ENCASHMENT:
The Managing Directors of Co-operative Sugar Factories are permitted to surrender 15 days of Earned leave for encashment purpose once in a calender year or 30 days of Earned Leave once in two years.
The Managing Directors recruited directly shall execute an agreement in the Form prescribed in this regard (enclosed as proforma) to serve in any of the Co-operative Sugar Factory in the State for a period not less than 2 years failing which they shall remit to Govt., the amounts specified in the Bond. No Managing Director shall be permitted to leave the Sugar Factory during the crushing season.
The Govt., shall be the authority to effect transfer of Managing Directors from one Co-operative Sugar Factory to another. The Managing Director shall draw his pay and allowances from the Co-operative Sugar Factory to which he stands transferred from the date of his relief from the previous factory.
The Government shall be the authority to accept the resignation of Managing Directors.
19. JOINING TIME:
The Managing Directors on transfer shall be eligible for 10 days joining time, including holidays. This includes journey time also.
20. PERFORMANCE EVALUATION:
Every year after crushing season the performance of the Managing Directors shall be evaluated by the Technical Committee to be constituted by the Director and Commissioner for Sugar."
Basing on the report of the Technical Committee the Director and Commissioner for Sugar will sanction increment.
The Government shall have the power to terminate the services of Managing Directors by serving of 3 months notice or 3 months pay in lieu thereof, and ;the officer can relinquish himself by giving 3 months advance notice or by refunding 3 months pay in lieu of advance notice"
22. PROVIDENT FUND/CONTRIBUTORY PROVIDENT FUND:
"10% of Provident Fund/Family Provident Fund contribution on basic + Dearness Allowance shall be deducted from the salary of the individual and the equal amount will be contributed by the Co-operative Sugar Factory. As the Provident Fund account is maintained by the Co-operative Sugar Factory there is no ceiling on Provident Fund deduction (Family Provident Fund @ Rs.58/- maximum per month i.e., 1 1/6% on basic + Dearness Allowance.
23. INTERPRETATION OF RULES:
If any doubt arises at any time, as to the interpretation of these rules or their application, the decision of the Government shall be final.
24. POWER OF THE GOVERNMENT:
The Government reserves the power to rescind, revoke, amend or vary any of the existing provisions of these rules in this regard.
