Read the following :-

ORDER:

            WHEREAS,Smt. Dr. A. Ankamma, W/o. Dr. Lakshman Naik Rathod worked as Civil AssistantSurgeon, Government Area Hospital, Narasaraopet, Guntur District from 2ndMay 2000 to 9th July 2001 as such she is a public servant within themeaning of clause (c) of section 2 of Prevention of Corruption Act, 1988 (Central Act 49 of 1988);

2.         ANDWHEREAS, Sri V. Srinivasa Rao, S/o. Veeranna, brother-in-law of the deceased K.Hanumantha Rao, resident of Satuluru Village of Guntur District.

3.         ANDWHEREAS, it is alleged that Sri V. Srinivasa Rao, brother-in-law of thedeceased K. Hanumantha Rao, who was a rice mill driver and died accidentally onRailway Track on 11th March 2001. A case was registered by theG.R.P., Guntur Railway Police. They sent the body of Hanumantha Rao forpostmortem examination to the Area Hospital, Narasaraopet on 12thMarch 2001. Smt. Dr. A. Ankamma conducted postmortem and she did not send thecopy of postmortem certificate either to the court or to the Railway PoliceG.R.P., Guntur. In the meanwhile, one V. Sreenivasa Rao, approached her twiceor thrice. Smt. Dr. A. Ankamma, Civil Assistant Surgeon, Government AreaHospital, Narasaraopet demanded from him initially an amount of Rs. 2000/- asbribe for issuing postmortem certificate. On his further request , Smt. Dr. A.Ankamma, Civil Assistant Surgeon, Government Area Hospital, Narasaraopetreduced the amount to Rs. 1000/-. On 25th April 2001, V. SreenivasaRao visited the hospital in the morning and requested Smt. Dr. A. Ankamma,Civil Assistant Surgeon, Government Area Hospital, Narasaraopet, to issuepostmortem certificate. Smt. Dr. A. Ankamma, Civil Assistant Surgeon,Government Area Hospital, Narasaraopet demanded again to bring the bribe amountfor issuing postmortem certificate. Smt. Dr. A. Ankamma insisted V. SreenivasaRao to go to her house at NGO Colony on 26th April, 2001 in theevening after 6.00 PM and she promised that she will send the report to thePolice and will allow him to get a copy of postmortem report soon afterpayment. Sri V. Sreenivasa Rao un-willing to pay the bribe amount to Smt. Dr.A. Ankamma, Civil Assistant Surgeon, Government Area Hospital, Narasaraopet, proceededto the office of the Inspector, Anti Corruption Bureau., Guntur and presented areport on 26.4.2001 morning at 8.30 AM. After verifying both the character andantecedents of both V. Sreenivasa Rao and Smt. Dr. A. Ankamma, Civil AssistantSurgeon, Government Area Hospital, Narasaraopet and after observing theprescribed procedure, the Deputy Superintendent of Police., Anti CorruptionBureau., Vijayawada registered the said report as a case in Cr. No.8/ACB-VJA/2001 u/s 7 of Prevention of Corruption Act, 1988 at 2.30 PM andinvestigated into the case.

4.         ANDWHEREAS, on 26th April 2001, at 7.40 PM, the Deputy Superintendentof Police, Anti Corruption Bureau., Vijayawada Range trapped Smt. Dr. A.Ankamma, Civil Assistant Surgeon, Government Area Hospital, Narasaraopet,Guntur District when she further demanded and accepted a bribe of Rs. 1000/-form V. Sreenivasa Rao for doing official favour of issuing postmortemcertificate as gratification other than legal remuneration. When both the handsfingers of Smt. Dr. A. Ankamma, Civil Assistant Surgeon, Government AreaHospital, Narasaraopet, subjected to the chemical tests, they proved positive.As per the instructions of the Deputy Superintendent of Police, one of themediators collected all the currency notes thrown away by Smt. Dr. A. Ankamma,Civil Assistant Surgeon, Government Area Hospital, Narasaropet, on the floor.The serial numbers of the tainted currency notes found tallied with the serialnumbers of the currency notes produced by V. Sreenivasa Rao during pre-trapproceedings. The Deputy Superintendent of Police, Anti Corruption Bureau,seized the tainted currency and certain documents / relevant records andconnected material etc., and further investigated into the case.

 5.        AND WHEREAS, the above acts of Dr. A.Ankamma, Civil Assistant Surgeon, Government Area Hospital, Narasaraopet,Guntur District constitute offences punishable under sections 7 and sub-section(2) of section 13 read with sub-clause(i) and (ii) of clause (d) ofsub-section(1) of section 13 of Prevention of Corruption Act, 1988
(Central Act, 49 of 1988);

 6.        ANDWHEREAS, the Government of Andhra Pradesh, being the competent authority toremove the said Smt. Dr. A. Ankamma, Civil Assistant Surgeon, Government AreaHospital, Narasaraopet, Guntur District from service after fully and carefullyexamining the material placed before them in respect of the aforesaidallegation and having regard to the circumstances of the case, consider thatthe said Smt. Dr. A. Ankamma, Civil Assistant Surgeon, Government AreaHospital, Narasaraopet, Guntur District should be prosecuted in a Court of Lawfor the aforesaid offences.

7.         NOW,THEREFORE, in exercise of the powers conferred by clause (b) of sub-section (1)of section 19 of the Prevention of Corruption Act, 1988 (Central Act 49 of1988), the Government of Andhra Pradesh hereby accord sanction for theprosecution of the said Smt. Dr. A. Ankamma, Civil Assistant Surgeon,Government Area Hospital, Narasaraopet, Guntur District for the above saidoffences punishable under section 7 and sub-section(2) of section 13 read withsub-clauses (i) and (ii) of clause(d) of sub-section 1 of section 13 ofPrevention of Corruption Act, 1988 (Central Act 49 of 1988) and for any othercognate offences punishable under any other provisions of law for the timebeing in force in respect of the aforesaid acts and for taking cognizance ofthe said offences by a Court of competent jurisdiction.
