O R D E R:-
Whereas, Sri Yelisetti Laxmi Veera Venkateswara Rao,S/o.Janardhana Rao, worked as Senior Assistant in the Office of Regional Director, Medical& Health Services,Rajahmundry from 1-1-1996 to 19-11-1998 and as such, he is a PublicServant within the meaning of clause (c) of sction 2 of the Prevention of Corruption Act,1988 (Central Act 49 of 1988);
2. And whereas, Sri Merugu Prema Solman Raju, S/o. Raja Rao is aresident of Koduru Village of Krishna District who is hereinafter called as thecomplainant and his wife Vijayalaxmi was working as Staff Nurse in the Primary HealthCentre: Koduru;
3. And whereas, it is alleged that Smt.D.Vijayalaxmi,Staff Nurse,Primary Health Centre:Koduru, W/o. Sri M.P.Solman Raju submitted a representation to theRegional Director, Medical & Health Services, Rajahmundry through proper channelseeking transfer to University General Hospital, Vijayawada. The representation wasforwarded by the Medical Officer, Primary Health Centre: Koduru to the District Medical& Health Officer, Machilipatnam, Krishna District on 9-6-1998. The District Medical& Health Officer, Machilipatnam forwarded the same to the Regional Director,Medical& Health Services, Rajahmundry on 11-6-98 vide Rc.No.2110/E2/98. The RegionalDirector, Medical & Health Services, Rajahmundry sent a letter to theRegistrar,University General Hospital, Vijayawada for no objection. On that, theRegistrar, University General Hospital, Vijayawada sent no objection certificate to theRegional Director, Medical & Health Services, Rajahmundry. On 18-11-1998 at 12.30 P.M.Sri M.P.Solman Raju went to the Office of Regional Director, Medical & HealthServices, Rajahmundry and met the Senior Assistant, Sri Y.L.V.Venkateswara Rao andrequested to handover the copy of transfer order of his wife. On that SriY.L.V.Venkateswara Rao, Senior Assistant demanded an amount of Rs.1500/- (Rupees onethousand five hundred only) as bribe to handover the copy of transfer order. SriM.P.Solman Raju expressed his inability to pay that much amount, but the Senior Assistantdid not accept his request. Sri M.P.Solman Raju, thereupon reluctantly agreed to pay thedemanded bribe amount of Rs.1500/- (Rupees one thousand five hundred only) to SriY.L.V.Venkateswara Rao and approached the Deputy Superintendent of Police, Anti CorruptionBureau, Rajahmundry and submitted a report on 19-11-1998 at 7.00 A.M.which was registeredon 19-11-1998 at 10.00 A.M. as a case in Cr.No.14/RC-RJY/98 by the Deputy Superintendentof Police,Anti Corruption Bureau, Rajahmundry.

And whereas, the Deputy Superintendent of Police,Anti-Corruption Bureau, Rajahmundry trapped Sri Y.L.V.Venkateswara Rao, Senior Assistant on19-11-1998 at 12.20 P.M. in his office room located in the Office of Regional Director,Medical & Health Services, Rajahmundry when Sri Y.L.V.Venkateswara Rao demanded andaccepted an amount of Rs.1500/- (Rupees one thousand five hundred only) as illegalgratification other than legal remuneration from Sri M.P.Solman Raju for doing officialfavour. The chemical test conducted on both the hand fingers of Sri Y.L.V.Venkateswara Raoand also on the inner linings of the shirt pocket of Sri Y.L.V.Venkateswara Rao provedpositive.The serial numbers of the tainted amount produced by the said SriY.L.V.Venkateswara Rao from his shirt pocket found tallied with the serial numbers of thecurrency notes noted in the mediators report No-I drafted on 19-111998 at the office ofDeputy Superintendent of Police, Anti Corruption Bureau, Rajahmundry.

And whereas, the above said acts of Sri Y.L.V.VenkateswaraRao, Senior Assistant, Office of the Regional Director, Medical & Health Services,Rajahmundry constitute the offence punishable under section 7 and sub-section (2) ofsection 13 read with clause (d) of sub-section(1) of section 13 of the Prevention ofCorruption Act, 1988 (Central Act 49 of 1988.);

And whereas, the Government of Andhra Pradesh being thecompetent authority to remove the said Sri Y.L.V.Venkateswara Rao, Senior Assistant,Office of Regional Director, Medical & Health Services, Rajahmundry from service afterfully and carefully examining the material placed before them ie., Final Report containingthe statements of witnesses, copy of First Information Report and copies of mediatorsreports No-I and II and other connected and relevant records in respect of the saidallegation and having regard to the circumstances of the case consider that the said Sri Y.L.V.Venkateswara Rao should be prosecuted in thecourt of law for the aforesaidoffences;

Now, therefore, in exercise of the powers conferred by clause(b) of sub-section (1) of section 19 of the Prevention of Corruption Act, 1988 (CentralAct 49 of 1988),the Government of Andhra Pradesh hereby accord sanction for theprosecution of the said Sri Y.L.V.Venkateswara Rao, Senior Assistant, Office of RegionalDirector, Medical & Health Services, Rajahmundry for the said offences punishableunder section 7 and sub-section (2) of section 13 read with clause (d) of sub-section (1)of section 13 of the Prevention of Corruption Act 1988 (Central Act 49 of 1988) and forany other cognate offences punishable under any other provisions of law for the time beingin force inrespect of the aforesaid acts and for taking congnizance of the said offencesby the court of competant jurisdiction.
