ORDER:

 

                In the G.Os Ist, 2nd and 3rd read above, orders were issued dispensing with the scheme of compassioante appointment to the dependents of Government employees who retired on Medical Invalidation, consequent to the Judgement  dated 12-10-2001 in W.P.No.13489/2000 and batch of High Court of Andhra Pradesh wherein it is held that the scheme is  unconstitutional and  violative of Article 16 of Constitution of India.

 

2.             In the G.O. 4th read above, orders were issued to consider appointments on contract basis to the post of Panchayat Secretary with a basic pay of Rs.2870/- + H.R.A. + D.A. to the dependents of Government employees who retired on medical invalidation  before issue of  G.O.Ms.No.202, General Administration (Ser.A) Department, dated 27-4-2002.  In the G.O. fifth read above, orders were issued on terms and conditions for contract appointment to the post of Panchayat Secretary (Category-V) to the dependents of Government employees who retired on Medical Invalidation before 27-4-2002.  In the G.O. Sixth read above, orders were issued to relax the educational qualification  of “Intermediate” in respect of those who passed S.S.C. examination only, so as to consider them,  for appointment on contract basis, to the post of Executive Officer, Special Category-V (Panchayat Secretary), and for payment of Ex-gratia to those who passed only 7th Class Examination, in lieu of the appointment on contract basis to the post of Panchayat Secretary.

 

3.             In the Memorandum Eighth read above the Joint Action Committee of Employees, Teachers and  Workers of Andhra Pradesh have requested  to keep all the appointments on contract basis to the post of Panchayat Secretary, Category-V to the dependents of

 Government employees who retired on medical invalidation outside the communal roster as already agreed to by the Cabinet Sub-Committee on Service Matters.  It is also requested therein that the dependents of the Government employees who retired on medical invalidation in the Offices in the Hyderabad District and in respect of Offices in Heads of Departments and in Departments of Secretariat, may be considered for appointment to the post of Panchayat Secretary, Category-V, on contract basis,  in other Districts,  because as per the orders issued  in G.O.Ms.No.144, Panchayat Raj and Rural Development  Department, dated 1-5-2003, the natives  of Hyderabad are not eligible to be appointed as Panchayat Secretary, as there is no post of  Panchayat Secretary in Hyderabad.

 

4.             Government after careful consideration have decided to consider the  request and order as follows:-

 

(i)   The orders in G.O.Ms.No.44, General Administration (Ser.A) Deptt., dated 17-2-2003, were issued keeping in view the hardship pleaded by the Government employees who retired on Medical Invalidation and in whose cases the Compassionate Appointment could not be considered due to dispensing with the scheme.  In such cases, the Dependents of the Government employees shall be considered for appointment to the post of Executive Officer, Special Category-V (Panchayat Secretary) on Contract Basis,  without observing the communal roster in making the appointments.

 

(ii) The cases of dependents of Government employees  who retired on Medical Invalidation before 27-4-2002 in the District Offices at Hyderbad District  and in the offices of Heads of Department and Departments of Secretariat, shall be considered for appointment  to the post of  Executive Officer Spl. Category-V (Panchayat Secretary) on Contract Basis,  in the Districts of Ranga Reddy,  Medak, Mahaboobnagar, Nalgonda or in other Districts, against non-local category in terms of orders issued in the  G.Os. 4th to 7th read above.

 

5.             The Panchayat Raj and Rural Development Department will issue suitable amendments to G.O.Ms.No.144, Panchayat Raj and Rural Development Department, dated 1-5-2003.
