ORDER:

 

            The Director of Treasuries and Accounts and Director, State Audit through the reference 9th & 10th read above have sought for a clarification on the competent transferring authorities in the light of G.O.Ms.No.179, Fin.& Plg.(FW.W&M) Department, dated:28.11.2000 and previous orders on transfers.

 

2.         After careful examination of the above proposals, it is hereby clarified that it is not the intention of the Government to curtail the existing power of the transferring authorities.  Hence, the following amendments to para 7 of G.O.Ms.No.179, Fin.& Plg.(FW.W&M) Department, dated:28.11.2000 are issued, with a view to further clarify and streamline the procedure to effect the transfers by the competent transferring authorities.

 

3.         The following Amendment is issued to the G.O.Ms.No.179, Finance and Planning (FW.W&M) Department, dated:28.11.2000.

 

AMENDMENT

 

            Para (i) to (iii) of G.O.Ms.No.179,  shall be substituted by para 7 (i) & (ii) as follows and Para 7 (iv) shall be re-numbered as para 7 (iii)

 

Para 7(i)           The authority competent to transfer is authorized to effect the transfers of employees for all such cases covered under the exemption clauses  (i) to (iv) under para (6) of G.O.Ms.No.177, Finance & Plg.(FW.W&M.I) Department, dated 16.10.1997 and under G.O.Ms.No.127, Finance & Plg.(FW.W&M) Department, dt.24.08.1999 without seeking any concurrence of Finance Department.

 

(ii)                However, it shall be mandatory for the transferring authority to certify the specific exemption clause under which the transfer has been made in the transfer order failing which the Treasury Officers / Pay & Accounts Officers concerned shall not admit T.T.A. bills into audit

 

(iii)       In respect of all other cases (both Gazetted and Non-Gazetted) for which relaxation of ban orders is required, on receipt of transfers proposals from the Heads of Departments the Secretary of the Department of Secretariat shall process the proposals giving due justification for the proposed transfer and shall obtain orders in circulation upto C.M. through the concerned Minister of the Department concerned and the Finance Minister.  After obtaining orders in circulation the Department of Secretariat shall send the proposal to Finance & Plg.(FW.W&M) Department for concurrence.
