ORDER :

                Electionsto the various agricultural credit and marketing Cooperative Societies were held in July1995.  According to the provisions of theAndhra Pradesh Cooperative Societies Act, 1964 the tenure of the elected committee is fora period of 5 years and now elections are due to be held in the month of July to August2000.

2.                Governmenthave constituted a Cabinet Committee to examine and to suggest comprehensive reforms inthe Cooperative law with a view to reform the Cooperative sector and functioning ofCooperatives in the State.  The Governmentdesire that the Cooperative Sector and Cooperatives should become vibrant self reliantinstitutions and organisations with greater membership participation and responsibilities,greater accountability of office bearers and the Cooperative function, in an environmentfree from interference and control.

3.             TheCabinet Sub Committee apart from considering various reports of the experts is alsoundertaking extensive consultation process to elicit views, suggestions from experts andpeople associated with the Cooperative Sector.

4.             TheGovernment there fore of the view that election to the cooperatives be conducted after thereforms take place.

 5.            Further, duringthe Khariff  season of 1999, due to adverseseasonal conditions the Agricultural Sector and particularly the farmers have sufferedconsiderably and with a view to ameliorate their conditions, the Government with the helpof NABARD has also taken up the task of rescheduling loans and providing assistance tofarmers.  Conduct of elections in thesecircumstances will cause hindrance to this relief process.

        In view of the above circumstances, the Government have decidednot to conduct elections for the time being to the powers conferred under Section 32 (7)(a) read with Section 131 of A.P.C.S. Act, 1964, direct that the elections should not beheld at present for all agricultural credit and marketing Cooperative Societies for whichthe Registrar of Cooperative Societies consider that it is not possible to call a generalmeeting for the purpose of conducting elections to the said societies so as to exercisethe powers of Registrar under the Act.

                TheGovernment also direct that on the expiry of the term of the existing elected Presidentsand Managing Committee Members, Persons – In-Charge shall be appointed by theappointing authority for a period of six months or till the elections are conductedwhichever is earlier except where such managing committees are deemed to be not fit andsuitable for running the affairs of the society in the interest of the society.  The Presidents and the Managing Committee Membersmay be appointed as Persons – In – Charge and they will function as a Committeeof Persons –In-Charge of the Societies and discharge all the functions of theCommittee and to take all such activities as may be required in the interest of thesociety as specified in the provisions of the said Act and Rules and bye laws madethereunder.
